If you are actively treating clients then this may well be the most important letter you could read. When I was at college the importance of maintaining accurate client records could not be over emphasized. I'm sure your massage teachers and instructors drummed the same message.

Client records perform a number of important roles -

The importance of client consent...

It never ceases to amaze me when a massage therapist ends up in court on a client complaint relating to 'consent'.

Yes, there are the unscrupulous massage therapists out there that grope and prod where they shouldn't and deserve everything that's coming to them.

But I'm talking about 'ethical' massage therapists, who for some reason, failed to obtain consent to include a particular body area in their treatment. Or, of even greater concern, the client who 'claims' no consent was given even if they did give consent at the time of treatment.

Protect yourself against fraudulent and unforeseen claims. By ticking boxes in the consent area of our client intake form, client's can easily indicate the body areas they consent to being treated.

Of course, it is essential that the proposed treatment be explained and client consent obtained prior to commencing any treatment.

Just because the client consented to a particular area being treated on a previous visit doesn't mean that the consent automatically extends to subsequent treatments.

The dangers of pre-existing conditions...

I'd like you to consider the case of a colleague of mine who's client ended up in hospital following a treatment. It was discovered that the client had herniated discs, something my colleague did test for (Valsalva Slump Test) but the results were negative.

Fortunately for my colleague, the client did not pursue legal action and no claim was made.

Pre-existing conditions either known or unknown to both client and therapist can put a therapist on thin ice if damage results from treatment. By maintaining concise records relating to known conditions and recording results of any additional tests performed, the massage therapist can readily prove that all known steps were taken to ensure the safety and well being of the client.

When things go wrong...

A few years back there was a report in the Australian press about a woman who ended up a quadriplegic after receiving a 15 minute seated-chair corporate massage.

Hmmm I hear you say. That's a bit of a worry. What could the massage therapist possibly have done to cause such damage?

The massage therapist concerned is at a complete loss as to how the injury occured. The family of the woman is considering legal action against the massage therapist!

"He remembers giving Asha a 15-minute massage at her work desk. He says he was not negligent and simply cannot believe that he has caused this damage.

He is qualified and holds a diploma in remedial massage from the Australasian College of Natural Therapies." Excerpt from Asha's massage mystery, Today Tonight, Channel 7, Australia.

In another report, a massage therapist was successfully sued after herniating a client's cervical discs whilst performing a 'manipulation'.

"Meri has been locked in a legal battle with the masseur who she claims sentenced her to a life of pain and after six years she has finally won an out of court settlement." Excerpt from Get the right massage, Today Tonight, Channel 7, Australia.

The above reports highlight a fact that every massage therapist should take into consideration -

Regardless of all the precautions we take, we are exposed to the posibility of litigation every time we treat a client.

How many times have you asked your client how they are progressing with your treatments only to hear, "Yeah, it feels about the same..".

I personally find this form priceless. The Pain Analysis Form is ideal when working with client's suffering from long term chronic pain.

If a client indicates that he or she has been suffering from long term chronic pain simply ask the him/her to complete the Pain Analysis Form at the time of their first visit. Then file it away.

After three (3) or four (4) treatments ask the client to fill the form out again (do not give them access to any pain analysis forms they have completed previously).

By comparing the answers given on the form that was completed at the time of the first visit to those given on the form after a few treatments you can get a clear indication of the effectiveness of your treatments.

In the majority of cases, the comparison will show an improvement that you can prove to your client (evidence based reporting).

Repeat the process as many times as you feel appropriate to provide ongoing feedback on the results of your treatments and proof to your client that your treatments are stabilising or improving their condition.
